Please read these terms carefully before accessing or using the MietIt platform.

Welcome to MietIt.

These Terms & Conditions ("Terms") govern your access to and use of the MietIt website, platform, applications, and related services (collectively, the "Platform").

MietIt is an online rental marketplace that enables users to discover rental listings, submit booking requests, make and manage bookings, process payments, and communicate information relating to rentals.

By creating an account, listing a rental, submitting a booking request, making a payment, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree with these Terms, you must not use the Platform.

1. About MietIt

  • MietIt operates an online platform that connects hosts who offer rental properties or accommodation with guests/renters who wish to make bookings.
  • MietIt provides technology and related platform services, including listing management, booking management, payment processing support, and communication tools.
  • Unless expressly stated otherwise, MietIt does not own, possess, operate, manage, or control the property or accommodation listed by a host.
  • The rental arrangement for a particular booking may be between the host and the guest/renter. MietIt facilitates the digital platform services associated with that arrangement.
  • Hosts remain responsible for the properties and listings they offer through the Platform.

2. Eligibility

To use MietIt, you must:

  • Provide accurate and complete information.
  • Be legally capable of entering into a binding agreement.
  • Use the Platform only for lawful purposes.
  • Maintain the security of your account.
  • Keep your account information accurate and up to date.

You must not create an account using false, misleading, fraudulent, or impersonated information. MietIt may request additional information where reasonably necessary for account security, payment processing, fraud prevention, legal compliance, or other legitimate platform requirements.

3. User Accounts

Certain features of MietIt require you to create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity conducted through your account.
  • Providing accurate information.
  • Not sharing your account in a manner that violates these Terms.

You should notify MietIt promptly if you believe that your account has been accessed without authorization or otherwise compromised. MietIt may suspend or restrict an account where there are reasonable grounds to suspect fraud, misuse, security risks, violation of these Terms, or other unlawful activity.

4. Hosts

Hosts may create listings for properties or accommodation that they are legally entitled to offer for rental. Hosts are responsible for ensuring that:

  • They have the necessary rights and permissions to offer the property.
  • Listing information is accurate and current.
  • Photos and descriptions fairly represent the property.
  • Pricing and availability are accurate.
  • Check-in and check-out information is accurate.
  • The property is reasonably safe and suitable for the advertised use.
  • The property complies with applicable laws, regulations, licenses, permits, and registration requirements.
  • They comply with applicable tax and rental obligations.

Hosts must not intentionally provide misleading information or conceal material facts relating to a listing. MietIt may request information reasonably necessary to verify a host, listing, payment account, or other information required to operate the Platform.

5. Guests and Renters

Guests/renters are responsible for:

  • Providing accurate booking information.
  • Reviewing listing information before making a booking.
  • Following applicable house rules and reasonable instructions provided by the host.
  • Using the property only for its permitted purpose.
  • Treating the property and its contents responsibly.
  • Complying with applicable laws and regulations.
  • Completing check-in and check-out according to the booking requirements.
  • Reporting relevant problems, damage, or safety concerns promptly.

Guests/renters must not use MietIt to arrange or facilitate illegal activities.

6. Listings and Host-Provided Content

Hosts are responsible for the accuracy and completeness of their listings. Listings may include property location, photographs, property descriptions, amenities and facilities, availability, pricing, rental conditions, check-in and check-out requirements, cancellation conditions, and house rules.

Photographs, videos, descriptions, and other materials uploaded by hosts are provided by the respective host. Hosts are responsible for ensuring that they have the necessary rights and permissions to upload and display such content and that the content fairly represents the listing.

MietIt may review, restrict, suspend, or remove a listing where reasonably necessary because of inaccurate information, suspected fraud, safety concerns, violation of these Terms, legal requirements, or other legitimate platform considerations.

MietIt does not guarantee that listing information supplied by a host is complete, accurate, current, genuine, or suitable for a particular purpose.

7. Booking Requests and Confirmations

Guests/renters may submit booking requests through the Platform. Depending on the listing and applicable booking process, a host may be required to approve a booking request before the booking becomes confirmed.

A booking becomes confirmed when the Platform indicates that the booking has been successfully confirmed. Users should rely on the booking information displayed in their MietIt account.

MietIt may cancel, restrict, or suspend a booking where reasonably necessary because of payment failure, suspected fraud, security concerns, technical problems, legal requirements, or violation of these Terms.

8. Pricing and Payments

  • The applicable price and charges for a booking will be displayed through the Platform before the relevant payment is completed.
  • Payments may be processed through third-party payment service providers, including Razorpay, where applicable.
  • Payment processing may involve authorization, capture, settlement, refund, cancellation, or other payment-processing steps depending on the transaction.
  • Users are responsible for providing valid payment information and authorizing the applicable payment provider to process the required payment.
  • Where payment processing is handled by a third-party payment provider, MietIt does not intentionally store complete payment card details.

9. Host Bank Information and Payouts

Hosts may be required to provide valid bank account and related payment information necessary to receive payouts. MietIt may use third-party payment providers to facilitate host payouts.

Host payouts may depend on:

  • Successful payment processing.
  • Valid payout information.
  • Booking status.
  • Applicable check-in and check-out conditions.
  • Refunds or disputes.
  • Fraud and security checks.
  • Payment-provider requirements.
  • Applicable legal or regulatory requirements.

MietIt may delay, hold, or restrict a payout where reasonably necessary to investigate a payment issue, refund, dispute, suspected fraud, security concern, or legal/compliance requirement.

MietIt does not guarantee a specific payout date where processing depends on a third-party payment provider or financial institution.

10. Cancellation

Bookings may be cancelled in accordance with the cancellation terms applicable to the relevant listing or booking.

The amount, if any, that may be refunded can depend on:

  • The applicable cancellation policy.
  • The time of cancellation.
  • The booking status.
  • The payment status.
  • Whether the host or guest/renter initiated the cancellation.
  • Other conditions applicable to the booking.

Users should review the applicable cancellation terms before completing a booking.

11. Refunds

Where a refund is applicable, MietIt may initiate or facilitate the refund through the payment provider used for the original transaction.

Refunds will generally be processed using the original payment method, where technically and legally possible.

The time required for a refund to appear in a user's account may depend on the payment provider, card issuer, bank, or other financial institution.

MietIt is not responsible for delays caused solely by external payment providers or financial institutions after a refund has been successfully initiated.

12. Check-in and Check-out

Users must follow the check-in and check-out procedures associated with their booking.

Where MietIt provides digital check-in or check-out functionality, users must provide accurate information and must not falsely report booking events.

Hosts and guests/renters may be required to confirm relevant booking events through the Platform.

Failure to follow the applicable check-in or check-out procedure may affect payment, refund, dispute, or payout processing where relevant to the booking.

13. Damage, Loss, and Misuse

Guests/renters may be responsible for damage, loss, or misuse caused by them or by persons they allow to access the property.

Hosts should report relevant damage or loss promptly and provide appropriate supporting information where requested.

MietIt may facilitate communication and, where applicable, payment-related processes associated with a damage claim.

MietIt does not automatically determine that a guest/renter is responsible for every damage claim. Relevant information and evidence may be considered in accordance with applicable platform procedures.

Nothing in these Terms removes any rights or remedies available under applicable law.

14. Prohibited Activities

Users must not use MietIt to:

  • Commit or facilitate illegal activities.
  • Provide false, misleading, or fraudulent information.
  • Conduct payment fraud or unauthorized payment activity.
  • Circumvent applicable MietIt payment processes.
  • Manipulate bookings, payments, reviews, or other Platform functions.
  • Create accounts for abusive or fraudulent purposes.
  • Harass, threaten, intimidate, or abuse other users.
  • Engage in unlawful discrimination.
  • Intentionally damage property.
  • Use a property for an unauthorized or unlawful purpose.
  • Upload malicious software or harmful code.
  • Attempt to gain unauthorized access to MietIt systems.
  • Scrape, copy, collect, or misuse Platform data without authorization.
  • Interfere with the operation or security of the Platform.
  • Engage in any activity prohibited by applicable law.

MietIt may take appropriate action where prohibited activity is identified.

15. User Content

Users may submit information, photographs, descriptions, reviews, messages, and other content through the Platform ("User Content").

Users are responsible for ensuring that their User Content:

  • Is accurate to the best of their knowledge.
  • Does not violate applicable law.
  • Does not infringe another person's rights.
  • Does not violate privacy or intellectual property rights.
  • Does not contain malicious software.
  • Is not intentionally fraudulent or misleading.

By submitting User Content, you grant MietIt a non-exclusive, worldwide, royalty-free license to use, reproduce, display, store, modify where reasonably necessary for technical purposes, and distribute that content solely as necessary to operate, maintain, improve, and promote the Platform, subject to applicable law and the MietIt Privacy Policy.

16. Reviews and Ratings

Where MietIt provides reviews or ratings, users must provide honest and relevant feedback based on their genuine experience.

Reviews must not be:

  • Fake or fabricated.
  • Manipulated.
  • Threatening or abusive.
  • Discriminatory.
  • Used to extort another user.
  • Deliberately misleading.

MietIt may remove or restrict content that violates these Terms or applicable platform rules.

17. Third-Party Services

MietIt may use third-party services to provide certain Platform functionality. These services may include authentication, hosting, payment processing, communications, analytics, security, and other infrastructure.

Third-party services may include providers such as Firebase / Google, Vercel, Razorpay, and other service providers used by MietIt.

Your use of third-party services may also be subject to the applicable provider's own terms and policies.

18. Intellectual Property

The MietIt name, branding, logos, website design, software, graphics, text, and other Platform materials may be protected by applicable intellectual property laws.

Except where permitted by law or expressly authorized by MietIt, users must not:

  • Copy Platform materials.
  • Reproduce or redistribute Platform content.
  • Modify or create derivative works from Platform software or materials.
  • Sell or commercially exploit Platform materials.
  • Reverse engineer or attempt to extract source code where prohibited by law.

19. Platform Availability

MietIt aims to provide a reliable Platform but does not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

Temporary interruptions may occur due to:

  • Maintenance.
  • Software updates.
  • Technical failures.
  • Third-party service failures.
  • Network or infrastructure problems.
  • Security incidents.
  • Events beyond MietIt's reasonable control.

MietIt may modify, suspend, or discontinue particular Platform features where reasonably necessary.

20. MietIt's Role as a Marketplace Platform

MietIt operates as an online marketplace and technology platform that connects hosts and guests/renters. MietIt does not own, possess, operate, manage, or control the properties or accommodations listed by hosts, unless expressly stated otherwise.

Property information displayed on MietIt, including photographs, descriptions, prices, availability, amenities, location information, house rules, and other listing details, may be provided by the relevant host. Hosts are responsible for ensuring that their listings and submitted content are accurate, lawful, and not misleading.

MietIt does not guarantee that every listing, photograph, description, host, guest/renter, property, or other information provided through the Platform is accurate, complete, current, genuine, or suitable for a particular purpose.

MietIt does not guarantee the identity, conduct, intentions, financial position, or reliability of any host or guest/renter. Users should exercise reasonable caution, review available listing information, and use appropriate judgment before making a booking or interacting with another user.

If a user suspects a fake listing, scam, fraudulent activity, unauthorized property listing, misleading information, unsafe conduct, or other suspicious activity, the user should report it to MietIt promptly. MietIt may investigate, restrict, suspend, or remove an account or listing where appropriate.

To the extent permitted by applicable law, MietIt is not responsible for losses resulting solely from fraudulent, misleading, unlawful, or otherwise improper conduct by another user or from information supplied by that user.

21. Liability

To the maximum extent permitted by applicable law, MietIt will not be responsible for losses arising solely from circumstances outside its reasonable control or from the independent actions, omissions, or misconduct of users.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Nothing in these Terms limits mandatory consumer protection rights or other statutory rights that apply to users under applicable law.

22. Indemnification

To the extent permitted by applicable law, a user may be responsible for losses, claims, liabilities, damages, and reasonable costs arising from:

  • Their unlawful use of the Platform.
  • Their violation of these Terms.
  • Their fraudulent or intentionally wrongful conduct.
  • Their infringement of another person's rights.

This section does not limit any rights or remedies that cannot legally be excluded.

23. Account Suspension and Termination

MietIt may suspend, restrict, or terminate an account where reasonably necessary, including where:

  • These Terms are violated.
  • Fraud or abuse is suspected.
  • False or misleading information is provided.
  • Payment activity presents a security or fraud concern.
  • Required payment or payout information is not provided.
  • The user's activity creates a significant safety or security risk.
  • Suspension or termination is required by law.

Where appropriate, users may contact MietIt regarding an account restriction or termination.

Termination of an account does not automatically cancel obligations or liabilities that arose before termination.

24. Changes to These Terms

MietIt may update these Terms from time to time.

Where material changes are made, MietIt may provide reasonable notice through the Platform, the user's account, email, or another appropriate communication method.

The latest version will always be published on this page with the applicable "Last updated" date.

Your continued use of MietIt after the effective date of updated Terms may constitute acceptance of the updated Terms, to the extent permitted by applicable law.

25. Privacy

MietIt processes personal information in accordance with its Privacy Policy.

The Privacy Policy explains how MietIt collects, uses, stores, protects, and shares personal information.

26. Governing Law and Dispute Resolution

These Terms are governed by applicable law.

If you have a dispute with MietIt, we encourage you to contact us first so that we can attempt to resolve the matter informally.

Nothing in this section prevents a consumer from exercising mandatory rights available under applicable law or accessing any competent court, authority, or legally available dispute-resolution mechanism.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally permitted.

The remaining provisions will continue to apply.

28. Entire Agreement

These Terms, together with the applicable policies and additional terms expressly referenced herein, govern your use of the MietIt Platform.

Acceptance

By creating an account, listing a property, submitting a booking request, making a payment, or otherwise using MietIt, you confirm that you have read and understood these Terms & Conditions and agree to comply with them, subject to your rights under applicable law.
